RealtyIQ is a real estate CRM platform that enables real estate professionals to:
- Manage client and lead relationships.
- Automate follow-up communications via email, SMS, and phone.
- Track transactions and milestones.
- Generate AI-powered content and communications.
- Access market intelligence and analytics.
3. Account Registration
To use the Service, you must create an account with accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Notifying us immediately of any unauthorized access.
You must be at least 18 years old to create an account.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including:
- CAN-SPAM Act: All marketing emails must include unsubscribe mechanisms, a physical address, and accurate sender information.
- TCPA (Telephone Consumer Protection Act): You must obtain prior express written consent before sending automated SMS messages or making automated calls to consumers.
- Do Not Call Registry: You are responsible for checking and honoring the National Do Not Call Registry before making outbound calls.
- State laws: You are responsible for compliance with state-specific real estate, marketing, and privacy laws.
- GDPR / CCPA: If applicable based on your clients' location, you must comply with data protection regulations.
5. Communication Compliance Responsibilities
You are solely responsible for ensuring that all communications sent through the Service comply with applicable law. This includes:
- Obtaining and maintaining valid consent from recipients before sending marketing emails or SMS messages.
- Honoring opt-out and unsubscribe requests promptly.
- Not sending unsolicited commercial messages.
- Accurately representing your identity in all communications.
RealtyIQ provides tools to help you stay compliant but does not guarantee legal compliance. You are responsible for your own compliance obligations.
6. Prohibited Conduct
You may not:
- Use the Service to send spam, unsolicited bulk emails, or mass SMS campaigns without proper consent.
- Violate any applicable law or regulation.
- Infringe on the intellectual property rights of others.
- Attempt to gain unauthorized access to any part of the Service.
- Use the Service to harass, intimidate, or harm any person.
- Reverse engineer, decompile, or disassemble the Service.
- Resell or sublicense the Service without our written consent.
7. Subscription & Billing
Paid plans are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method. Subscriptions automatically renew unless cancelled. Refunds are provided at our discretion in accordance with our refund policy.
8. Free Trial
We offer a 14-day free trial for new accounts. No credit card is required during the trial. After the trial period, continued use requires a paid subscription.
9. Data and Privacy
Our collection and use of personal information is governed by our Privacy Policy, incorporated into these Terms by reference. You grant us a limited license to use client data you upload solely to provide the Service.
10. Intellectual Property
The Service, including its design, features, and content, is owned by us and protected by intellectual property laws. You retain ownership of data you input into the Service.
11. Disclaimers
The Service is provided "AS IS" without warranties of any kind. We do not warrant that:
- The Service will be uninterrupted or error-free.
- AI-generated content will be accurate or suitable for any purpose.
- Use of the Service will ensure legal compliance with any specific law.
12. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amounts paid by you in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless RealtyIQ from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any third-party rights or applicable law.
14. Termination
Either party may terminate these Terms at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Data may be retained for a period as described in our Privacy Policy.
15. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable federal law and the laws of the state where you reside.
16. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes via email or within the Service. Continued use after changes constitutes acceptance of the updated Terms.
